PRINSIP TANAH WALAKA PADA MASYARAKAT HUKUM ADAT TOLAKI DALAM SISTEM PERTANAHAN

Abstract

The issue of the existence of ulayat right needs to get a logical and proportional thinking, where the view of it is on the one hand there is a concern that ulayat land that was not existed then declared live again, and in others are concerned that the increasing demand for land will further urges ulayat rights whose existence is guaranteed by Article 3 of the BAL. Similarly, the Tolaki Tribe people have customary law regarding land. Land Ownership Adat according to custom Tolaki known there is a customary land owned and owned either individually or in groups. Under Article 3 of the BAL relating to Walaka land which is controlled in groups as a unity of indigenous peoples will be acknowledged as long as it still exists.
