RANGKAP JABATAN NOTARIS SEBAGAI PEMIMPIN BADAN USAHA
Abstract
Within legislation of Notary Public Functional Position (Undang-Undang Jabatan Notaris) it is mentioned about rights, obligation and prohibition for notary public. Article 17 section 1 F of Notary Public Functional Position (Undang-Undang Jabatan Notaris) mentioned that one of prohibition for notary public is that he/she cannot served two/double positions at the same time which are as notary public and director; or officer of state owned business entities; regional owned business entities or private business. This study will analyze the ratio legis prohibition for Notaries to concurrently serve as leaders of business entities and the legal consequences for Notaries who hold concurrent positions as leaders of business entities and efforts to resolve if Notaries are also business leaders.
