Publication Ethics

Publication Ethics and Malpractice Statement

Derogasi Hukum is committed to upholding the highest standards of publication ethics and takes all possible measures against publication malpractice. This statement is based on the principles and guidelines of the Committee on Publication Ethics (COPE), the Principles of Transparency and Best Practice in Scholarly Publishing, and internationally recognized standards of scholarly publishing.

All parties involved in the publication process, including authors, editors, reviewers, and the publisher, are expected to adhere to these ethical principles. Any form of unethical publishing behavior is unacceptable. The journal reserves the right to investigate allegations of misconduct and to take appropriate actions, including rejection, correction, retraction, or removal of published articles when necessary.

The journal employs plagiarism detection software to screen all submissions. Manuscripts found to contain plagiarism, duplicate publication, data fabrication, falsification, or other forms of research misconduct will be rejected or retracted in accordance with COPE guidelines.

EDITOR RESPONSIBILITIES

Publication Decisions

The Editor in Chief and Editorial Board are responsible for deciding which submitted manuscripts should be published. Editorial decisions are based on the manuscript's scholarly merit, originality, significance, clarity, and relevance to the journal's scope. Editors may consult reviewers and members of the Editorial Board in making publication decisions.

Fairness and Impartiality

Editors evaluate manuscripts solely on their intellectual content without regard to the authors' race, ethnicity, nationality, gender, sexual orientation, religious beliefs, institutional affiliation, citizenship, or political philosophy.

Confidentiality

Editors and editorial staff must maintain the confidentiality of all submitted manuscripts. Information regarding a manuscript shall not be disclosed to anyone other than the corresponding author, reviewers, editorial advisers, and the publisher, as appropriate.

Conflict of Interest

Editors shall not use unpublished information disclosed in submitted manuscripts for their own research or personal advantage. Editors must recuse themselves from handling manuscripts in which they have conflicts of interest arising from competitive, collaborative, financial, institutional, or other relationships with any of the authors or organizations connected to the manuscript.

Handling Allegations of Misconduct

Editors will follow COPE guidelines in addressing allegations of plagiarism, citation manipulation, duplicate publication, data fabrication, unethical research practices, authorship disputes, and other forms of publication misconduct.

REVIEWER RESPONSIBILITIES

Contribution to Editorial Decisions

Peer review assists editors in making publication decisions and helps authors improve the quality of their manuscripts.

Confidentiality

Reviewers must treat all manuscripts as confidential documents and must not disclose or discuss them with others except as authorized by the editor.

Objectivity

Reviews should be conducted objectively and constructively. Personal criticism of authors is inappropriate. Reviewers should provide clear, reasoned, and evidence-based comments to support their recommendations.

Acknowledgment of Sources

Reviewers should identify relevant published work that has not been cited by the authors and notify the editor of any substantial similarity or overlap between the manuscript under review and other published works known to them.

Conflict of Interest

Reviewers should decline to review manuscripts in which they have conflicts of interest resulting from competitive, collaborative, financial, institutional, or other relationships with the authors, organizations, or institutions connected to the manuscript.

Timeliness

Reviewers who feel unqualified to review a manuscript or are unable to provide a timely review should promptly notify the editor and withdraw from the review process.

Peer Review Process

Derogasi Hukum implements a double blind peer review process, in which both reviewers and authors remain anonymous throughout the review procedure. Each manuscript is initially assessed by the editorial team and, if deemed suitable, is reviewed by at least two independent reviewers.

AUTHOR RESPONSIBILITIES

Reporting Standards

Authors must present an accurate and objective account of the work performed and provide sufficient detail and references to permit replication of the research. Fraudulent or knowingly inaccurate statements constitute unethical behavior and are unacceptable.

Originality and Plagiarism

Authors must ensure that their work is entirely original. If the work or words of others have been used, they must be appropriately cited or quoted. Plagiarism in all its forms constitutes unethical publishing behavior and is unacceptable.

Multiple, Redundant, or Concurrent Publication

Authors should not submit the same manuscript simultaneously to more than one journal or publish substantially similar research in multiple journals without proper justification and disclosure.

Data Availability and Retention

Authors may be required to provide the raw data associated with a manuscript for editorial review and should retain such data for a reasonable period after publication. Authors are encouraged to make research data publicly available whenever possible and appropriate.

Authorship and Contributorship

Authorship should be limited to individuals who have made substantial contributions to the conception, design, execution, analysis, or interpretation of the study. All individuals who have made significant contributions should be listed as authors, while others who contributed to the work should be appropriately acknowledged.

The corresponding author is responsible for ensuring that all co-authors have reviewed and approved the final manuscript and agreed to its submission.

Disclosure and Conflicts of Interest

Authors must disclose any financial, institutional, personal, or professional relationships that could be perceived as influencing the results or interpretation of their research. All sources of funding must be clearly identified in the manuscript.

Ethical Research Standards

Authors must ensure that research involving human participants, personal data, or other sensitive subjects has been conducted in accordance with applicable ethical standards, regulations, and institutional requirements.

Use of Artificial Intelligence (AI)

Authors must disclose the use of artificial intelligence (AI) tools in the preparation of manuscripts where applicable. AI tools cannot be listed as authors because they cannot assume responsibility for the submitted work. Authors remain fully responsible for the accuracy, originality, and integrity of the manuscript.

Corrections and Retractions

When authors discover a significant error or inaccuracy in their published work, they must promptly notify the editor and cooperate in issuing a correction, retraction, or other appropriate notice.

PUBLISHER RESPONSIBILITIES

The publisher supports the editorial team in maintaining the integrity, transparency, and ethical standards of scholarly publishing. The publisher is committed to ensuring editorial independence and preventing commercial interests from influencing editorial decisions.

The publisher works closely with editors to address allegations of misconduct and to ensure that corrections, clarifications, retractions, and apologies are published when necessary.

COMPLAINTS AND APPEALS

Authors may appeal editorial decisions or submit complaints regarding the editorial process. Appeals and complaints will be handled fairly, transparently, and in accordance with COPE guidelines. All cases will be investigated thoroughly before a final decision is made.

RETRACTION POLICY

Derogasi Hukum reserves the right to retract published articles in cases involving plagiarism, duplicate publication, data fabrication, falsification, unethical research practices, serious errors affecting the reliability of findings, or other forms of publication misconduct. Retraction procedures will follow COPE Retraction Guidelines.

COPYRIGHT AND OPEN ACCESS

Articles published in Derogasi Hukum are made available under the journal's copyright and licensing policies. Authors retain responsibility for ensuring that all copyrighted materials used in their manuscripts have been appropriately acknowledged and permission has been obtained where required.
